Right of Entry (ROE) / Accessing Property
Any entry or construction activities on railroad right of way must be authorized by the railroad in writing. Written authorization is obtained through a Right of Entry (ROE) Permit or Contractor Occupancy/Access Agreement.

APPLICATION PROCESS
WHAT YOU'LL NEED (IMPORTANT!)
Incomplete applications may be rejected!
To avoid delays, please ensure your submission includes:
- Latitude and longitude, plus an aerial map of the proposed worksite
- A complete scope of work (what you are doing, how you are doing it, and when)
WHAT TO EXPECT AFTER YOU APPLY
After you submit your application online, the primary contact listed on the application will receive an email confirming we have received your submission and requesting any additional documents needed to complete intake and begin review.
To help us process your request as quickly as possible:
- Reply to the email you receive and attach the requested documents
(PDF, Excel, and Word formats are accepted). - Include your File ID in the subject line of all email correspondence.
- Submit each document only once. Duplicate submissions may delay processing!

TERM
The standard term for a Right of Entry (ROE) Permit or Contractor Occupancy/Access Agreement is sixty (60) days. Longer terms are reviewed on a case-by-case basis and may be subject to additional fees.
REVIEW & APPROVAL PROCESS (HIGH-LEVEL)
- Upon receipt, the Real Estate team will review the package for approval. Submission does not guarantee approval.
- If approved, an agreement will be drafted and forwarded to the applicant for signature.
- The applicant must return the signed agreement along with the certificate of insurance demonstrating the insurance requirements outlined in the agreement.
- Once all of the required items are received, the agreement will be executed on behalf of the railroad.
PROCESSING TIMES
- Standard processing is typically 6–8 weeks (but may be longer during high-volume periods).
- With expedited processing, you should receive an agreement within 1–2 weeks after receiving all required information, for an additional $3,000.
- Note: If engineering review is required and plans must be revised to meet specifications, expedited timelines may extend.
FEES & PAYMENTS
- The Right of Entry (ROE) fee is typically $1,750.
- Expedited processing (optional) is available for an additional $3,000.
Please do not submit fees at the time you apply. After initial review, we will confirm the services required and send an invoice with payment instructions.
Tip: Please include the invoice number on your remittance and correspondence (and include your File ID if one has been provided).
